General
All services provided by Holda GmbH to the customer are provided exclusively on the basis of the following terms and conditions. Different rules are only valid if they have been agreed between Holda GmbH and the customer.
Conclusion of the contract
Holda GmbH’s offers on the Internet represent a noncommittal request towards the customers to order in the online shop.
By ordering the desired goods on the internet, the customer makes a binding offer to conclude a sales contract.
Holda GmbH is entitled to accept this offer within 1-3 calendar days by sending an order confirmation. The order confirmation is sent via e-mail. If a 7-day period expires without notice, the offer is rejected.
Delivery
All Universal products are shipped immediately if they are available in Coverking, Anaheim. For international deliveries, the delivery period is unless otherwise stated in the offer, a maximum of 14 working days.
Customized products have a longer delivery time of 4-6 weeks.
Should a product not be available at short notice, we will notify you by e-mail about the expected delivery time, providing we have been provided with an e-mail address. Your statutory rights are not affected.
Delivery costs
The cost per item for deliveries to the United Arab Emirates, Saudi Arabia, Jordan, Israel, Oman, Algeria, Morocco and South Africa are listed on our website.
Upon request, courier or express deliveries can also be carried out at an additional expense.
Payment
All quoted prices are final.
The following payment methods are possible:
Cash in advance, the customer is obligated to pay the purchase price immediately after conclusion of the contract by bank transfer to our account. When paying in advance you will receive an email with the exact invoice data. Therefore, please enter necessarily your email address and / or phone number in the order form, and we will get in touch with you. Please specify in your payment as the order number, so we can allocate your payment.
Paypal, the customer is obligated to pay the purchase price immediately after contract conclusion via Paypal on our Paypal account.
Until full payment; the delivered goods remain our property (property pursuant to §§ 158, 449 BGB). If the agreed payment period is exceeded, we have to charge reminder and processing fees. Power of revocation
Exclusion right of withdrawal – Custom made products Our custom made goods are excluded from exchange and return. In case of deficiency the customer has the statutory warranty rights.
Warranty
In case of transport damages to the goods, the recipient has to immediately make a report the damage to the carrier (shipping service). Other recognizable transportation damages are to be notified in writing at the latest within 2 days after receipt of the goods.
We are not liable for defects that have arisen due to incorrect handling, normal wear and tear or due to external influences. Repairs to the goods on your own initiative or by third parties who were made without our written consent, void our warranty.
Production liability
Your statutory warranty period is 2 years and begins on receipt of the goods. Within this time, we will remove or repair all defects subject to the statutory warranty period. You may request either the removal of the defect or the delivery of conforming goods, where the right to choose may be limited to legal conditions. If subsequent performance fails, you are entitled to cancel the contract or reduce the purchase price. Moreover, the legal right to compensation, the compensation for the damage applies. Upon the occurrence of a defect within 6 months after delivery of the goods, it shall be presumed that the goods were already defective at the handover. If the material defects after the expiration of six months after delivery, the buyer must prove that the defect was present upon delivery of the purchase object.
Data protection
The information you provide will be used by us solely to process your orders. All personal information will remain strictly confidential. Your personal data will be used for the optimal handling of the order, to the delivery of the goods, the provision of services and to process the payment. For this purpose, we pass your data on to authorized service providers and, where appropriate, to affiliated companies. For the purpose of payment processing the requisite data is stored both on our server as well as on the servers of the company commissioned by us for payment processing.
The Order and payment data is encrypted and backed up, however, we assume no liability for data security during transmission over the internet (e.g. due to technical problems of the provider) or for any criminal access to files or our internet presence. Access for the customer login, which are transmitted to the customer on his request, are to be treated by the customer with strict confidentiality, as we assume no responsibility for the use and utilization of this data.
