(“Custom Products,” “Coverking,” “we,” “us,” or “our”), the operator of coverking.com and its related sites, subdomains, and services (collectively, the “Site”), collects, uses, discloses, and protects your Personal Information when you visit, browse, register, communicate with us, or make a purchase. This Privacy Policy applies to Personal Information we collect through the Site and through related customer interactions that reference this Policy, including online orders, account registration, customer support, surveys, promotions, and marketing communications. Your use of the Site is also governed by our Terms of Service, which contains important provisions — including a binding arbitration agreement, a class-action and jury-trial waiver, limitations of liability, and the governing law and venue that apply to disputes. Those provisions are incorporated into this Policy by reference and apply to disputes relating to your privacy and Personal Information to the fullest extent permitted by law. This Policy does not apply to third-party websites, platforms, or services we do not control.

When you place an order, your payment information is collected and processed through Shopify Checkout and its payment service providers. We do not store full payment card numbers on our own servers. We maintain reasonable administrative, technical, and physical safeguards designed to protect Personal Information, including encryption in transit (TLS) for the transmission of certain information.

However, no method of transmission over the Internet and no method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot and do not guarantee its absolute security, and you provide your information at your own risk. To the maximum extent permitted by applicable law, we disclaim any liability for unauthorized access to, alteration of, or loss, misuse, or disclosure of information that occurs despite our reasonable safeguards. You are responsible for keeping your account credentials confidential and for using a secure network and device when accessing the Site. If you believe your interaction with us is no longer secure, please contact us promptly. In the event of a data breach, we will provide notice to affected individuals and authorities to the extent and within the timeframes required by applicable law.

We disclose Personal Information to the following categories of recipients for the business and commercial purposes described in this Policy: our affiliates and corporate group; service providers and contractors that operate our business (including payment processors, hosting, IT, communications, shipping and fulfillment, customer-support, marketing, analytics, and fraud-prevention providers); advertising, analytics, and marketing partners; data and marketing partners; professional advisors, auditors, and insurers; and successors and other parties in connection with a corporate transaction.

We may also disclose Personal Information when we believe in good faith that disclosure is appropriate or necessary to comply with applicable law, regulation, legal process, subpoena, or governmental or law-enforcement request; to enforce our agreements, terms, and policies; to collect amounts owed; to detect, prevent, or investigate fraud, security, or technical issues; to protect the rights, property, or safety of Custom Products Inc., our customers, our personnel, or others; or in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, or sale or transfer of some or all of our assets or business, in which Personal Information may be transferred to the successor or acquirer as a business asset.

We and our advertising and analytics partners use cookies, pixels, tags, SDKs, and similar technologies to understand Site usage, measure and optimize advertising performance, personalize content and offers, build audiences, and serve ads to you on the Site and across other websites, apps, and services. These activities may involve the disclosure of device, online, usage, commercial, and inference information to advertising, analytics, and data partners and may constitute “targeted advertising,” “cross-context behavioral advertising,” a “sale,” or “sharing” of Personal Information under certain privacy laws.

We reserve the right to sell or share Personal Information and to engage in targeted and cross-context behavioral advertising to the fullest extent permitted by applicable law. Where a particular activity is treated as a sale or sharing under the law of your state, you may exercise the opt-out choices described below. Except as required by applicable law, opting out is your responsibility, and we are not required to obtain your prior consent before engaging in these activities for adults. You may opt out of certain targeted advertising through the Network Advertising Initiative at thenai.org/opt-out, the Digital Advertising Alliance at optout.aboutads.info, and Google Ads Settings at adssettings.google.com. Opting out of one device or browser does not opt out others, and opting out of targeted advertising does not stop all data disclosures or all advertising.

Depending on your state or country of residence and subject to applicable law and the exceptions described below, you may have the right to know about and access the Personal Information we hold, to request correction or deletion, to obtain a portable copy, to opt out of marketing, and to opt out of the sale or sharing of Personal Information or of targeted advertising. To exercise these rights, email support@coverking.com or write to us at the address below. We will take reasonable steps to verify your identity before responding, and we will respond within the timeframes required by applicable law, which we may extend to the maximum period the law allows. We will not discriminate against you for exercising rights that cannot be denied under applicable law.

We may decline, limit, or charge a reasonable fee for a request to the extent permitted by law, including where a request is manifestly unfounded, excessive, repetitive, or unverifiable, or where retaining or using the information is necessary to complete a transaction, provide a service you requested, ensure security, detect or prevent fraud, comply with a legal obligation, maintain records, exercise free speech, or establish, exercise, or defend legal claims. Rights described in this section apply only to the extent granted to you by the law of your jurisdiction and do not create rights that the law does not require.

California residents have the right to know, access, correct, delete, and obtain a portable copy of their Personal Information; the right to opt out of the “sale” or “sharing” of Personal Information; and the right not to receive discriminatory treatment for exercising these rights. As described above, our use of certain advertising and analytics technologies may constitute a sale or sharing of Personal Information, and we reserve the right to sell or share Personal Information to the fullest extent permitted under the California Consumer Privacy Act, as amended by the CPRA. Financial incentives or differences in price or service that are reasonably related to the value of the data are permitted and are not unlawful discrimination.

To opt out of sale or sharing, use the “Do Not Sell or Share My Personal Information” link on our Site, enable the Global Privacy Control (GPC) signal in your browser (which we will treat as a valid opt-out request to the extent required by California law), or email support@coverking.com. We will respond to verifiable requests within 45 days and may extend this period by an additional 45 days where reasonably necessary and permitted. Authorized agents may submit requests with valid proof of authorization, and we may require you to verify your identity directly and confirm that you authorized the agent. We do not knowingly sell or share the Personal Information of consumers under 16 years of age. We are not required to honor opt-out preference signals other than those the law specifically requires us to recognize.

Residents of other U.S. states with comprehensive privacy laws may have similar rights to access, correct, delete, obtain a copy of, and opt out of the sale of Personal Information, targeted advertising, and certain profiling. We honor these rights only to the extent, and only for the residents, that the applicable state law requires, and we apply all exemptions and response periods (including any permitted extensions) available under that law. If you are in the EEA or UK, our lawful bases for processing may include: performance of a contract to process your orders, payments, shipping, and customer service; our legitimate interests in operating, securing, and improving our business, preventing fraud, developing products, building customer insights, and marketing our products, where not overridden by your rights; your consent for certain marketing and non-essential cookies; and compliance with legal obligations. You have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to withdraw consent at any time (which does not affect processing that occurred before withdrawal). Where we rely on legitimate interests, you may object based on your particular situation.

Where we transfer Personal Information from the EEA or UK to countries without an adequacy decision (including the United States), we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses and, where applicable, the UK International Data Transfer Addendum. Our processor Shopify processes such data in accordance with its Data Processing Addendum.

We retain Personal Information for as long as we have a legitimate business need or interest in doing so, and in any event for as long as reasonably necessary to fulfill the purposes described in this Policy, to operate and improve our business, to comply with our legal, tax, accounting, warranty, and regulatory obligations, to resolve disputes, to enforce our agreements, and to establish, exercise, or defend legal claims. Retention periods vary based on the type of information, the purpose for which it is held, and applicable legal requirements; order and transaction records are generally retained for at least the periods required by tax, accounting, and warranty obligations. When we no longer have a legitimate business need to retain Personal Information, we will delete, de-identify, or aggregate it, or, if that is not feasible, securely store it and isolate it from further use until deletion is possible.

We and our service providers use automated tools to detect and prevent fraud, secure the Site, personalize content and advertising, build audiences, and conduct analytics and profiling. We do not make decisions that produce legal or similarly significant effects concerning you based solely on automated processing without human involvement where such involvement is required by applicable law.

By providing your mobile number and affirmatively subscribing to Coverking text notifications, you provide your prior express written consent to receive recurring automated promotional and personalized marketing text messages from Coverking at the number you provided, including messages sent using an automatic telephone dialing system or other automated technology. Consent is not a condition of any purchase. Message frequency varies, and message and data rates may apply.

You may opt out of marketing texts at any time by replying STOP (or END, CANCEL, UNSUBSCRIBE, or QUIT), and you can reply HELP for help or contact us at support@coverking.com. After you opt out, you may receive a one-time confirmation message, and you may continue to receive transactional or service messages where permitted. You represent that you are at least 18 years old and the account holder or authorized user of the mobile number provided. To the extent permitted by law, carriers are not liable for delayed or undelivered messages, and we are not responsible for any charges imposed by your carrier. If your mobile number changes or is reassigned, you agree to promptly notify us. We may change, suspend, or terminate our text messaging program at any time.

If you receive marketing emails from us, you may unsubscribe using the link in any email or by contacting us. Opting out of marketing does not opt you out of transactional, service, legal, product-safety, warranty, recall, fraud-prevention, or account-related communications, which are not promotional.

A cookie is a small amount of information downloaded to your device when you visit our Site. We and our partners use strictly necessary, functional, performance, advertising, and analytics cookies and similar technologies. Where required by applicable law, we obtain consent before using non-essential cookies. You can manage cookie preferences through the tools available on the Site, your browser settings, or the opt-out links above. Blocking or deleting cookies may affect Site functionality and may not, by itself, opt you out of all disclosures to advertising partners unless you also use the applicable privacy controls.

Because there is no uniform industry or legal standard for responding to “Do Not Track” (DNT) browser signals, we do not respond to DNT signals. We recognize the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of Personal Information to the extent we are required to do so under applicable law. Because GPC is browser- and device-specific, you may need to enable it on each browser and device you use.

The Site is intended for adults and is not directed to children. We do not knowingly collect Personal Information from children under the age of 16, and we do not knowingly sell or share the Personal Information of consumers under 16 years of age. If you are a parent or guardian and believe a child under 16 has provided us with Personal Information, please contact us at support@coverking.com so we can take reasonable steps to delete it.

Our Site may contain links to, and may integrate, websites and services operated by third parties, and third-party services (including social media platforms, advertising networks, payment providers, and shipping providers) may collect information directly from you under their own privacy policies. We are not responsible for the independent privacy practices of those third parties, and this Policy does not apply to them. We encourage you to review their policies before providing any information to them.

This Privacy Policy is intended to describe our privacy practices and, except for rights that cannot be waived under applicable law, does not create contractual or other legal rights or obligations. To the maximum extent permitted by applicable law, the Site, its content, and this Policy are provided on an “as is” and “as available” basis without warranties of any kind, and Custom Products Inc., its affiliates, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to this Policy or our collection, use, disclosure, or handling of Personal Information, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

This Policy is governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict-of-laws principles. Any dispute, claim, or controversy relating to your privacy, your Personal Information, or this Policy is subject to the dispute-resolution provisions in our Terms of Service, including the binding individual arbitration agreement, the class-action, collective-action, and jury-trial waiver, the applicable limitations and time bars, and the governing-law and venue provisions, to the fullest extent permitted by applicable law. Nothing in this section limits any privacy right or remedy that cannot be waived under applicable law. If any provision of this Policy is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it.

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. We will post the revised version with an updated “Last updated” date, and changes become effective immediately upon posting. Your continued use of the Site after we post changes constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
